“Honoring with deep respect and gratitude our partner, mentor and friend, Carlos Müggenburg RV, founding partner of our Firm, whose legacy and memory will never be forgotten.”

Carlos Müggenburg, founding partner of the law firm Müggenburg, Gorches y Peñalosa and professor at the Escuela Libre de Derecho in Mexico City, has died at the age of 69.

He was born on August 16, 1951, into a family whose principles and education were governed mainly by deep religiosity, integrity and love of the country. He obtained his professional degree as a Lawyer at the Escuela Libre de Derecho in 1975 with a specialty in Fiscal Law at the Universidad Panamericana in 1979.

Carlos was a multidisciplinary lawyer who throughout his professional career practiced various areas of law, excelling in all of them, possessing a great legal culture that he always cultivated, enriched and shared. Throughout his brilliant career, Carlos distinguished himself particularly in the practice of transactional, corporate, real estate, intellectual property and arbitration law.

Among his recent activities and positions were:

Founding Partner of Müggenburg, Gorches y Peñalosa, SC in 2007, member of the Mexican Bar Association, AC, member of the Illustrious and National Bar Association of Mexico, AC, member of the Board of Directors of the Intellectual Property Commission of the International Chamber of Commerce, Mexican Chapter, AC, Secretary of the Board of Directors of Christel House Mexico, AC, Secretary of the Board of Directors of Pro Opera, AC, member of the Board of Directors of Colegio Junípero, AC, President and Secretary of the Board of Directors of various companies, Director of the Editorial Committee of the Escuela Libre de Derecho, member of the Board of Directors of the Escuela Libre de Derecho. From 2001 until before his death, Arbitrator in Arbitration of the International Chamber of Commerce, the Arbitration Center of Mexico and the National Chamber of Commerce, member of the Board of Directors and Coordinator of Working Groups of the Mexican Association for the Protection of Intellectual Property, AC (AMPPI).

In previous years he served as:

Member of the Working Groups of the Mexican Institute of Industrial Property of Industrial Property Law Reform Projects, Treasurer of Les México, AC (Licensing Executives Society International), Advisory member of the Intellectual Property Board of the Business Coordination for Treaties of Free Trade (COECE), Expert Witness in International Arbitration.

He was a mentor to many generations of lawyers through his work as a professor at the Escuela Libre de Derecho (from 1976 to date), and he was also an important and generous source of knowledge for all the lawyers who at some point were part of his team of collaborators; He always made the time to share his knowledge with others. He was the author of various articles and essays in some of the most prestigious national and international legal publications.

Among its clientele were some of the most important international companies worldwide, in segments such as the auto parts and automotive industry, air transport, food, tourism, technology, health and pharmaceuticals, real estate, financial, insurance, logistics services, etc. . Throughout his life, Carlos worked Pro-Bono with many associations and civil society organizations dedicated to culture and education.

Without a doubt, Carlos Müggenburg was an exceptional man, firm in his convictions and with a high sense of ethics, values and professional excellence, a great lawyer, a great human being and a dear friend. Always committed to his work, to his clients, to his beloved Escuela Libre de Derecho, Carlos leaves a deep mark on all those who had the fortune to coincide with him.

Despite his responsibilities and multiple work commitments and the time he dedicated to teaching, his priority was always his family, his wife and daughters, he greatly enjoyed the time with them, as well as the pranks of his grandchildren. All of them were always his greatest source of pride.

Social networks were filled with condolences when the unfortunate news of his death was known, the phones did not stop ringing lamenting his loss, and innumerable expressions of affection, solidarity and support arrived for his family, for his partners and for all the great Müggenburg family, Gorches and Peñalosa, for their colleagues and friends.

We will miss Carlos very much and he will always be remembered, we have his great professional legacy and an example of humanity, enormous strength, simplicity and love for life; He will always be alive in those of us who knew him and had the fortune to live with him.

Education

Mr. Gorches holds a law degree from the Universidad Iberoamericana, where he graduated in 1992. He later did graduate work at the Southwestern Legal Foundation, University of Texas at Dallas in 1995 in Comparative Law and at the Association for Overseas Technical Scholarship, Asia Pacific Industrial Property Center and Japan Institute of Invention and Innovation in Tokyo in 1997 (Industrial Property Rights Training Course for Lawyers and Industrial Property Rights Training Course for APEC Economies).

Mr. Gorches has more than 30 years of experience focusing his professional practice mainly in the area of Litigation (administrative, constitutional and amparo, civil and commercial, cyber law /information technology, intellectual property, entertainment, energy and infrastructure, economic competition, environmental, foreign trade / customs, ports, government acquisitions, product liability). In 1989, Mr. Gorches joined the law firm Creel, García-Cuéllar y Müggenburg, SC where he co-directed the Litigation practice, the same practice that in 2008 was fully absorbed by Müggenburg, Gorches y Peñalosa, SC.

Mr. Gómez Sáinz holds a law degree from the Universidad Iberoamericana in 1997, special award to the thesis work by the University. Mr. Gómez Sáinz has over twenty-five years of experience, focusing his practice primarily on the areas of Corporate Law, Real Estate and Mergers and Acquisitions.

He collaborates with merger and consolidation transactions and stockholder acquisitions of foreign and Mexican corporations, and he has participated in some of the most representative transactions in recent years in México in the banking sector, as well as in the automotive and auto parts industries, food, security systems, computer operating systems and equipments, aeronautics, etc. He collaborates in the preparation, review and negotiation of all kinds of agreements related to corporate transactions and those for the day to day operation of his clientele. Likewise, Mr. Gómez Sáinz has among his clientele some foreign banking institutions to which he advises in the grating of financing in Mexico in diverse industry and commercial sectors.

Mr. Gómez Sáinz has advised domestic and foreign clients in diverse real estate transactions in the touristic, manufacturing and logistics industries, among others, and also has developed the practice of legal advice in internal corporate disputes at shareholders level in some of the family-owned companies and conglomerates in Mexico.
